Jeffery Lee

Jeffery Lee was executed by the state of Alabama on the evening of September 17, 2026, at the William C. Holman Correctional Facility in Atmore. The execution, carried out by lethal injection, began just after 6 p.m. and Lee was pronounced dead at 6:22 p.m. He was 49 years old.

His execution came three months after a federal judge permanently barred Alabama from using nitrogen gas to put him to death, ruling on June 9, 2026, that the state's nitrogen protocol was unconstitutionally cruel. Lee had originally been scheduled to die by nitrogen gas on June 11, 2026, but the U.S. Supreme Court that day declined, by a 6 to 3 vote, to lift the lower court's block, and the execution did not proceed. Alabama Governor Kay Ivey subsequently set a new date, announcing on July 30, 2026, that Lee would instead be executed by lethal injection on September 17, 2026.

In his final statement before the execution, Lee told his family that he loved them and addressed the other men on Alabama's death row, referring to them as his brothers and saying he loved them as well. Prison officials confirmed the execution proceeded on schedule after last minute appeals were exhausted.

Reaction was mixed and largely reflected the divisions that had surrounded the case for years. U.S. Representative Terri Sewell, who represents the district that includes Orrville, said Lee's crimes were heinous and inexcusable and that her thoughts remained with the families of Jimmy Ellis and Elaine Thompson, who she said had endured decades of grief. Alabama Attorney General Steve Marshall said the state's focus throughout the case had been on securing justice for the victims. Opponents of the death penalty and some of Lee's advocates continued to argue that his case was troubling because a jury had originally recommended a life sentence, only for a judge to override that decision under a practice Alabama has since abolished. No public funeral or memorial arrangements for Lee had been announced as of the day after his execution.

On 12 December 1998 Lee robbed Jimmy's Pawn Shop in Orrville, killing owner Jimmy Ellis (known as the singer Orion) and Elaine Thompson, and wounding Helen King. Surveillance and his later confession identified him as the shooter.

Lee was arrested in Georgia the day after the killings. He faced two capital-murder counts and attempted murder; a brother and cousin were also arrested in connection with the case.

In 2000 a jury convicted him but recommended life without parole by 7-5. Judge Jack Meigs overrode the jury and imposed death on 11 October 2000, calling the shootings cold and premeditated.

Direct and collateral appeals failed in Alabama courts, the 11th Circuit, and the U.S. Supreme Court over more than a decade. Lee remained among inmates whose death sentences rested on pre-2017 judicial override.

Alabama ended judicial override in 2017, signed by Governor Kay Ivey, but the statute was not retroactive. Later efforts to resentence override cases failed in the legislature, leaving Lee's sentence intact.

A nitrogen-hypoxia warrant for 11 June 2026 was blocked when Judge Emily Marks enjoined that method as potentially cruel and unusual; the Supreme Court refused to lift the stay.

Alabama rescheduled lethal injection for 17 September 2026. After Ivey denied clemency and the Supreme Court rejected a final stay, Lee was executed at Holman and pronounced dead at 6:22 p.m. CT.

Jimmy Ellis was a nationally known Elvis-style singer under the name Orion; Elaine Thompson worked at the shop; Helen King survived and testified through the case's long aftermath. Officials framed the execution as closure for their families.
